These Terms govern your use of FightFund. By using the platform, you agree to them.
1. Acceptance of these Terms
FightFund is operated by FightFund Inc., a United States corporation ("FightFund," "we," "us," or "our"). FightFund provides an online crowdfunding platform that lets organizers create fundraising campaigns and donors contribute to them. By accessing or using FightFund, creating an account, donating, or organizing a campaign, you agree to be bound by these Terms of Service and our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund Policy, which are incorporated by reference. If you do not agree, do not use FightFund.
2. Eligibility
FightFund is currently available only in the United States and processes payments in U.S. dollars. You must be at least 18 years old and able to form a binding contract to use FightFund. Organizers must be U.S. residents with a valid U.S. bank account and must complete identity verification (KYC) and payout onboarding before funds can be released.
3. Your account
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at help@fightfund.com if you suspect unauthorized use.
4. Donations
Donations made through FightFund are voluntary contributions. Donors should make giving decisions based on their own judgment. FightFund Inc. is a technology platform, not a broker, charity, custodian, or financial adviser, and does not guarantee that any campaign will achieve its goal or that funds will be used as described by the organizer.
Donations are generally non-refundable except as described in our Refund Policy. Donors may add an optional tip to FightFund at checkout; tips are never required.
5. Organizer responsibilities
If you organize a campaign, you represent that all information you provide is truthful and accurate, that you are authorized to raise funds for the stated purpose and beneficiary, and that you will use the funds only as described. Every campaign is reviewed before it can accept public donations, and verification requirements scale with category and risk.
You agree to provide additional documentation upon request and to promptly deliver funds to the stated beneficiary where you are raising on someone else's behalf. You are solely responsible for any tax obligations arising from funds you receive.
6. Fees
Creating a campaign is free. When funds are paid out, FightFund charges a platform fee of 5% (3% for verified Pro organizers), plus a payment processing fee charged by our payment processor (Stripe). These fees are disclosed before payout. Optional donor tips to FightFund are separate and never required.
7. Payments, verification, and payouts
Payments and payouts are processed through Stripe and are subject to Stripe's terms. Before any payout is released, organizers must complete identity verification (KYC) through Stripe Identity and payout onboarding through Stripe Connect. Funds are held and reviewed before release; first payouts are subject to a minimum hold period after settlement and review. FightFund may delay, hold, or decline a payout where a campaign is under review, disputed, or suspected of violating these Terms.
8. Prohibited campaigns and conduct
You may not use FightFund to raise funds for, or engage in, anything illegal, fraudulent, misleading, hateful, or harmful. A full list of prohibited uses is set out in our Acceptable Use Policy. We may remove content, suspend campaigns, freeze funds, and terminate accounts that violate these rules or the Acceptable Use Policy.
9. Content and license
You retain ownership of the content you submit. You grant FightFund a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use your content to operate, secure, and promote the platform and your campaign. You are responsible for ensuring you have the rights to any content you upload.
10. Copyright and DMCA notices
FightFund respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on FightFund infringes your copyright, send a written notice to our designated agent at help@fightfund.com that includes: (a) your signature; (b) identification of the copyrighted work; (c) the URL of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf. We may remove infringing content and terminate repeat infringers.
11. Trust & Safety
We provide tools to report campaigns and we review reports through our Trust & Safety process. We display factual trust labels and never claim a campaign is "guaranteed safe." We reserve the right, but assume no obligation, to monitor, investigate, remove, or restrict any campaign or account.
12. Third-party services
FightFund relies on third-party services, including Stripe (payments, payouts, and identity verification) and email delivery providers. Your use of those services through FightFund is subject to their respective terms and privacy policies. FightFund is not responsible for the acts or omissions of third-party providers.
13. Disclaimers
FightFund is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any campaign's stated purpose is accurate.
14. Limitation of liability
To the maximum extent permitted by law, FightFund Inc. and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funds, profits, or data, arising from your use of the platform. Our total aggregate liability for any claim will not exceed the greater of the fees we earned on the relevant transaction or one hundred U.S. dollars ($100).
15. Indemnification
You agree to indemnify and hold FightFund Inc. harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your campaigns, content, use of the platform, or violation of these Terms or applicable law.
16. Dispute resolution and binding arbitration
Please read this section carefully — it affects your legal rights. Except where prohibited by law, you and FightFund Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of FightFund will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court.
Class-action waiver. You and FightFund agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing help@fightfund.com with your name and a statement that you wish to opt out of arbitration.
17. Governing law
These Terms are governed by the laws of the State of Louisiana, United States, and applicable U.S. federal law, without regard to conflict-of-laws principles. Subject to the arbitration section above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Louisiana, and you consent to their personal jurisdiction and venue.
18. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above, and material changes will be communicated where appropriate. Your continued use of FightFund after changes take effect constitutes acceptance.
